The Federal High Court in Abuja has dismissed the no-case submission filed by Nnamdi Kanu, leader of the proscribed Indigenous People of Biafra (IPOB), in the terrorism case brought against him by the Federal Government.
Ruling on Friday, Justice James Omotosho held that the Department of State Services (DSS) had established a prima facie case against Kanu, who must now open his defence.
The judge also directed the Nigerian Medical Association (NMA) to set up an eight to ten-member panel—including a cardiologist, neurologist, and the Chief Medical Director of the National Hospital—to assess Kanu’s health and fitness to stand trial. The panel is expected to submit its report within eight days.
The case is expected to resume on October 8 for consideration of the medical report and possible continuation of trial.
Kanu, who has been in detention since June 2021 following his return from Kenya, faces a seven-count terrorism charge.
